Xabi, procesado dentro del macro-sumario 18\/98, fue condenado a 4 a\u00f1os de c\u00e1rcel. A finales del mes de abril, la Audiencia Nacional espa\u00f1ola dict\u00f3 la orden de detenci\u00f3n contra Otero al entender que la absoluci\u00f3n comunicada por el Tribunal Supremo sobre otros nueve procesados, supon\u00eda impl\u00edcitamente la condena definitiva del resto. La sentencia definitiva del Tribunal Supremo se public\u00f3 tras la detenci\u00f3n de Otero, y rebajaba la condena a dos a\u00f1os de c\u00e1rcel. A pesar de que esta condena debi\u00f3 de suponer su excarcelaci\u00f3n inmediata, Xabi Otero no abandon\u00f3 la prisi\u00f3n gallega de Curtis hasta dos semanas despu\u00e9s.
